Terms of Service

1. Acceptance of Terms

By accessing and using Sufficient Care Transport (SCT) services, including our website, mobile applications, and driver/customer portals, you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions, do not use our services.

2. Services Provided

SCT is a licensed non-emergency medical transportation (NEMT) provider serving Nashville and surrounding areas. We provide:

• Scheduled and same-day ride services for medical appointments
• Specialized transportation for patients with mobility needs (ambulatory, wheelchair, stretcher)
• Insurance billing and invoice management
• Dispatch coordination and real-time ride tracking

All services are subject to driver availability, vehicle capacity, and scheduling constraints.

3. Rider Responsibilities

• Accurate Information: Provide truthful contact information, medical needs, and appointment details.
• Punctuality: Be ready at your scheduled pickup time. Rides departing without the customer are subject to cancellation fees.
• Conduct: Treat drivers and staff with respect. Abusive, threatening, or violent behavior will result in immediate service termination and potential legal action.
• Health Disclosures: Inform SCT of contagious illnesses, special equipment needs, or behavioral concerns prior to booking.
• Physical Condition: Ensure mobility assistance devices (canes, walkers, wheelchairs) are in safe working condition.
• No Weapons: Weapons, firearms, explosives, and illegal substances are strictly prohibited.

4. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• SCT shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of revenue, profit, or data.
• Our total liability for any claim arising from these terms shall not exceed the amount paid for the specific ride in question.
• SCT is not responsible for delays, cancellations, or service interruptions caused by traffic, weather, vehicle breakdown, driver illness, or circumstances beyond our reasonable control.
• Riders assume all risk of injury or property damage during transportation. SCT's liability is limited to insurance coverage provided.
• SCT is not liable for missed medical appointments, treatment delays, or health outcomes resulting from transportation.
• SCT does not provide medical care or emergency services. For medical emergencies, dial 911 immediately.

5. Insurance & Risk Assumption

SCT maintains commercial general liability and vehicle insurance covering riders during transportation. However:

• Riders accept all risk of injury or illness during the ride.
• Insurance coverage is limited to SCT's policy limits and exclusions.
• Riders waive the right to sue SCT for ordinary negligence.
• SCT is not responsible for pre-existing medical conditions or complications.
• Riders with health concerns should consult their physician before using our services.

6. Payment & Billing

• Base Fare: $50 minimum per ride, plus mileage at standard rates.
• Payment Methods: Insurance billing, credit card, or cash upon completion.
• Cancellation Fees: Rides cancelled less than 2 hours before scheduled time incur a $15 cancellation fee.
• No-Show Fees: $25 fee charged for customers not ready at pickup time.
• Disputed Charges: Must be reported within 30 days. SCT may require GPS data or driver testimony as evidence.
• Late Payments: Accounts overdue by 30 days may be referred to collections.

7. Privacy & Data Protection

Your personal and medical information is protected under our Privacy Policy and applicable HIPAA regulations. By using SCT services, you authorize us to:

• Collect and store contact, medical, and insurance information.
• Share data with dispatchers, drivers, and billing partners as necessary.
• Track your location during rides via GPS for safety and dispatch purposes.
• Retain records for audit, legal, and operational purposes.

8. Driver Code of Conduct

All SCT drivers are independent contractors trained in safe, professional transportation:

• Valid driver's license and insurance required at all times.
• Vehicles inspected regularly for safety and cleanliness.
• Background checks and driving record screening performed annually.
• Professional conduct and customer confidentiality required.
• Zero tolerance for substance abuse or driving under the influence.

Riders may report driver misconduct to dispatch at (615) 919-1656. SCT investigates all complaints and may terminate driver contracts.

9. Dispute Resolution & Arbitration

Any dispute arising from these terms shall be resolved through:

1. Good faith negotiation between parties (14 days).
2. Binding arbitration under Tennessee law if not resolved.
3. Arbitration conducted by a neutral third party in Davidson County.
4. Each party bears their own legal costs unless arbitrator awards otherwise.

Both parties waive the right to a jury trial or class action.

10. Modifications to Terms

SCT reserves the right to modify these terms at any time. Continued use of services after modification constitutes acceptance. We will provide 30 days' notice of material changes via email or app notification.

11. Termination of Service

SCT may suspend or terminate a customer's account for: non-payment, abusive conduct, false information, policy violations, or legal requirements. Termination is effective immediately, and refunds will not be issued for suspended accounts.

12. Governing Law

These terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Jurisdiction and venue lie exclusively in Davidson County, Tennessee courts, except for arbitration disputes.
